You agree to defend, indemnify, and hold harmless QueByM and its officers, directors, shareholders, affiliates, employees and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising from your use of QueByM website or your breach of these Terms of Use or your violation of any law or the rights of a third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfilment of any of your obligations under this Agreement or arising out of violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. These terms and conditions are in addition to the existing QueByM Terms of Use. eCoupons are also not offered to, and shall not be used by, such Users who under any statutory obligations are prohibited to use eCoupons. eCoupon is the property of Rinaya Ventures has the right to cancel the eCoupons at will and at any time (including during the validity period of the eCoupon) without giving any prior intimation to the User. eCoupon is a privilege from Rinaya Ventures and not a right or claim against Rinaya Ventures. eCoupons can also be cancelled in case the user is in violation of QueByM's Terms of Use. User using the eCoupons in any manner shall be deemed to have read, understood and accepted these terms and conditions. The value and the mode of using the eCoupon are mentioned in the electronic communication. The validity of eCoupon is subject to the condition that the User remains a registered user and is neither suspended nor in violation of QueByM Terms of Use. eCoupons can be redeemed only on purchases made through Quebym.com on those listings which provide an option of eCoupon payments. eCoupons shall be invalidated in case of rejection of payment by Rinaya Ventures due to risk containment measures. eCoupons cannot be used to buy any item which is illegal or prohibited by Terms of Use. eCoupon carries no cash value and cannot be transferred, negotiated or sold and cannot be redeemed against cash. eCoupons cannot be combined with any other coupons or any other offer or gift vouchers/cards or discounts or promotions. One eCoupon can be used only for one purchase irrespective of the value of such purchase and the unutilized or underutilized value of the eCoupons shall be forfeited and the User cannot claim any benefit or a substitute eCoupon in lieu of the same. The purchase value of the item in excess of the value of the eCoupon shall be paid by the User along with using the eCoupon.

This user agreement and all the rules and policies contained herein and any of your usage of the website and your dealings at QueByM.com shall be governed and construed in accordance with the Law of India. Orders are normally considered complete only after the payment has been received by QueByM.com unless the order is on complete Cash on Delivery (COD) To confirm the orders, our jewellery consultants at QueByM.com may call up the users who have placed orders through the website at any given time.

In the event the bank rejects to honour any payment transaction made by a user towards an order, QueByM.com shall have the right to refuse to ship the order to the user without any liability whatsoever. In the event the payment gateway selected by the user has flagged the transaction as fraudulent due to any reason, QueByM.com shall have the right to refuse to ship the order to the user without any liability whatsoever. In such a case, the user may receive a call from our Customer Service Team for relevant documents required to confirm the transaction, and if the fraudulent flag is not removed by the payment gateway, QueByM.com may not be able to fulfil the order. The paid amount will be refunded via the same payment mode.

QueByM.com does not own any of the diamonds listed on the website and other products listed are made to order in-house or manufactured by a third party. In such cases, QueByM.com only orders the products listed on the website from third-party traders and merchants after the confirmation of the order by the user and delivers the same to the user. In such a scenario, there is a possibility that the item ordered by the user might have certain constraints in fulfilment and the same will be updated to the user. In the event the diamond(s) get(s) traded in the market before making the payment / sealing the order, QueByM.com will call the user and suggest an alternative diamond. In case the user chooses a new diamond, QueByM.com shall confirm the new order. If the cost of the new selection is more expensive than the previous one, the user shall have to pay the differential amount. If the cost of the new selection is less expensive than the previous one, QueByM.com shall refund the excess amount to the user in the manner specified below in this Terms of Use. Diamond prices vary from one category of diamonds to another and seller to seller where numerous factors like reputation of the sellers, brand value, design of the jewellery etc. have an impact on the price of the diamond. The demand and supply of diamonds in the market can also affect the price of diamonds. The prices stated on the website may be substantially higher or lower than the actual prices in the retail markets accordingly. All pricing information available on the website must be used as a general guideline for diamond and gemstone prices. While this website is designed to provide the most accurate pricing information, the information about the diamonds does not provide an appraisal or guarantee of value, nor does it give suggestions or recommendations of any sort for buying or selling diamonds. The product weight mentioned on the website for jewellery and amounts may vary upon manufacture of the product. In case, the customer receives a product of lesser product weight than the value paid for, the company will refund such differential amount to the customer. Similarly, in case the product is of a higher weight than the value paid for, an additional cost will be applicable for the same to the buyer. The difference in weight will be disclosed only after the final product is ready.
